While stuff like PS3 Skyrim is inexcusable, their games have massive scale and a lot of checks to constantly make. Not to excuse them either, but it's atleast somewhat understandable why their games would be so hard to QA for. Telltale make incredibly simple games, yet can't even nail the performance when nothing is variable, like a game where mostly unknown amount of stuff can be on screen at once. That, and they have issues with save states, which is the only thing the game needs to track. They're obviously much smaller, but it's kinda crazy to me.
